PERSONAL DATA PROTECTION LAW PUBLIC DISCLOSURE TEXT

We, as EKS Law Office, are paying regard to personal data of all our clients and employees and all entities and institutions being a party to business partnership with us, and are striving for keeping them in strict confidence.

This Public Disclosure Text is prepared in respect of personal data collected and acquired by EKS Law Office in the course of its activities, within the frame of its public disclosure obligation arising out of the Personal Data Protection Law no. 6698 (“KVKK”).

For Which Purposes Will Your Personal Data be Processed

Your personal data may be processed only in accordance with the procedures and principles specified in KVKK and other applicable laws and regulations pertaining thereto. Personal data refers to and stands for all kinds of information relating to an identified or identifiable natural person, while processing of personal data refers to and stands for all kinds of processes conducted on personal data, such as acquisition, recording, storage, safekeeping, modification, rearrangement, disclosure, transfer, receipt, making available, classification, or prevention of use, of personal data either by fully or partially automatic ways and means or by non-automatic ways and means, providing that they are a part of any data registration system.

Personal data may be processed only with an explicit consent of data subject. However, pursuant to article 5/2 of KVKK, personal data may also be processed by EKS Law Office without an explicit consent of data subject, in the following cases:

  • If it is clearly specified and envisaged in the applicable laws; or
  • If it is absolutely necessary for protection of life or bodily integrity of a person who is unable to express his consent at that time due to actual impossibility or whose consent cannot legally be deemed valid under the available circumstances, or for protection of life or bodily integrity of another person; or
  • If and when personal data of parties to a contract are required to be processed, providing that it is directly related to establishment, execution or performance of that contract; or
  • If it is a necessity for performance of legal obligations and liabilities of EKS Law Office; or
  • If the subject personal data have already been made public by the data subject himself; or
  • If processing of data is necessary for establishment, use or protection of a certain right; or
  • If processing of data is necessary for protection of legitimate interests of EKS Law Office, providing that the fundamental rights and freedoms of the data subject are not prejudiced thereby.

Data regarding race, ethnic origin, political thoughts, philosophical beliefs, religion, sect or other beliefs, attire or appearance, membership of associations, foundations or unions, healthcare, sexual life, criminal convictions or security measures of individuals, and biometric and genetic data are considered and treated as specific personal data. Processing and transfer of specific personal data are permitted only with a prior explicit consent of the related persons. Personal data not related to health and sexual life may, however, be processed without an explicit consent of the related persons only in cases clearly specified in the applicable laws (KVKK article 6/1-2-3).

Now and therefore, we, as EKS Law Office, hereby agree and undertake to process your personal data only in accordance with laws. Your personal data may be processed by EKS Law Office only for such purposes as designing and performance of all kinds of human resources activities of our Law Office, and management and further improvement of personnel and recruitment processes, and conduct of commercial activities of our Law Office through employment of personnel of the required qualifications, and protection of legitimate rights and interests of EKS Law Office.

Transfer of Your Processed Personal Data to Third Parties

Personal data cannot be transferred without an explicit consent of the data subject. However, upon occurrence of any one of the events listed in article 5/2 of KVKK and providing that adequate measures are taken beforehand, upon occurrence of any one of the events listed in article 6/3 of KVKK, personal data may be transferred to third parties without a prior consent of the related data subject.

Your personal data may be transferred by EKS Law Office to third parties for any one of the purposes listed above pursuant to articles 8 and 9 of KVKK and in accordance with the applicable laws.

Method and Legal Cause of Collection of Your Personal Data

We, as EKS Law Office, are collecting personal data verbally, in writing or via electronic media by automatic or non-automatic methods in the course of our legal advice services within the frame of article 5 of KVKK.

Rights You Have as a Data Subject

Data subjects may, as per article 11 of KVKK, apply to EKS Law Office and use any one of the following rights in respect of themselves:

  • To learn whether their personal data are actually processed or not; and
  • If processed, to request information about processing of their personal data; and
  • To learn the purpose of processing of their personal data, and whether they are used for the intended purposes or not; and
  • To learn identity of third parties to whom their personal data are transferred at home or abroad; and
  • If their personal data are processed incompletely or inaccurately, to request correction of them; and
  • To request deletion or destruction of their personal data under the conditions specified in article 7 of KVKK; and
  • To request notification of said correction, deletion or destruction processes to third parties to whom their personal data are transferred; and
  • To raise objections against consequences that may arise against them through analysis of the processed personal data solely and exclusively by means of automatic systems; and
  • To claim compensation of damages and losses, if any, suffered due to unlawful or illegal processing of their personal data.

Pursuant to article 5 of the Communiqué on Procedures and Principles of Application to Data Supervisor, the requests for use of any one of the rights listed in the preceding subparagraphs are required to be transmitted and delivered by data subjects to EKS Law Office’s electronic mail address info@ekshukuk.com or to its mail address Cumhuriyet Cad. No:201/11 Harbiye Şişli, İstanbul/ Turkey in writing or by using registered electronic mail (KEP) address, secure electronic signature or mobile signature or by using the electronic mail address of data subject which has previously been designated to EKS Law Office and is already registered in the system of EKS Law Office, or through a software or application specifically developed for the purpose of application.  

Applications of data subjects are required to contain such information as name and surname, and if the application is in writing, signature, and as for nationals of the Republic of Turkey, T.R. identity number, and as for foreigners, passport number or if any, identity number, and notice address or office address, and if any, electronic mail address, telephone and facsimile numbers for notices.

All information and documents regarding the subject are attached to the application. With regard to your requests and complaints transmitted by you to us as Data Supervisor, we are going to revert to you freely within maximum 30 days as specified in article 13 of KVKK, unless the underlying transaction requires a separate cost.
